1. Acceptance of Terms
By creating an account on Schoolarise (“the Service”), operated by Schoolarise (“we,” “us,” or “our”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, you may not use the Service.
If you are under 18 years of age, a parent or legal guardian must review and agree to these Terms on your behalf. Your account will not be activated until verifiable parental or guardian consent is provided, in accordance with our age verification policy and applicable law including the Children's Online Privacy Protection Act (COPPA).
2. Description of the Service
Schoolarise is an AI-powered study platform that provides students with personalized tutoring, quizzes, flashcards, notes, knowledge mapping, and assignment tracking. The Service is intended for educational purposes only.
The AI tutor provides study assistance but is not a substitute for professional instruction. Responses are generated by artificial intelligence and may occasionally contain inaccuracies. Users should verify important information with qualified educators or authoritative sources.
3. Age Requirements
- You must be at least 5 years old to use the Service.
- Users under 18: A parent or legal guardian must provide verifiable parental consent via email before your account is activated. Subscription purchases and billing are handled by the parent or guardian. The parent or guardian may review, manage, set usage limits on, or delete the account at any time through the Parent Dashboard.
- Users 18 and older: You may create and manage your own account, purchase a subscription, and use the Service independently without restriction.
We collect date of birth at registration to enforce this policy. Providing a false date of birth to circumvent the age gate is a violation of these Terms and may result in immediate account termination.
4. Account Responsibilities
- You are responsible for maintaining the confidentiality of your password and for all activity that occurs under your account.
- You must provide accurate and complete information when creating your account, including a truthful date of birth.
- You must notify us immediately if you become aware of any unauthorized use of your account.
- You may not create multiple accounts, share your account credentials, or allow others to access your account.
5. Acceptable Use
You agree not to use the Service to:
- Submit content that is unlawful, abusive, threatening, harmful, defamatory, or otherwise objectionable.
- Attempt to manipulate or misuse the AI tutor to generate content unrelated to educational purposes.
- Use the Service to complete graded assignments, exams, or assessments in violation of your school's academic integrity policies.
- Reverse-engineer, decompile, or attempt to extract the source code of the Service.
- Use automated scripts, bots, or scraping tools to access the Service.
- Interfere with or disrupt the Service, its servers, or networks connected to the Service.
- Impersonate any person or entity, or falsely state or misrepresent your affiliation with any person or entity.
We reserve the right to suspend or terminate accounts that violate these rules, with or without notice.
6. Subscription Plans and Payments
- Schoolarise offers free and paid subscription plans. The features and limits of each plan are described on our Pricing page.
- Paid subscriptions are billed on a recurring basis (monthly or annually) through Stripe. By subscribing, you authorize us to charge the payment method on file.
- Users under 18 may not purchase a subscription directly. A parent or legal guardian must create a parent account and manage any paid subscription on the minor's behalf.
- You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of the current billing period. No refunds are provided for partial billing periods.
- We reserve the right to change pricing with 30 days' notice. Price changes will not affect your current billing period.
7. Intellectual Property
- Our content: The Service, including its design, code, AI models, branding, and documentation, is owned by Schoolarise and is protected by intellectual property laws. You may not copy, modify, or distribute any part of the Service without our written permission.
- Your content: You retain ownership of the study materials, notes, and other content you create on the Service. By using the Service, you grant us a limited license to store and process your content solely for the purpose of providing the Service to you.
- AI-generated content: Responses generated by the AI tutor are provided for your personal educational use. These responses may not be unique and we make no claim of ownership over them.
8. Privacy
Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information. By using the Service, you consent to the collection and use of your information as described in the Privacy Policy.
9. Children's Privacy (COPPA)
Schoolarise complies with the Children's Online Privacy Protection Act (COPPA), 15 U.S.C. § 6501–6506, and its implementing regulations.
- Age gate — under 18: We require parental or guardian consent for all users under the age of 18. This exceeds COPPA's minimum requirement (under 13) and reflects our commitment to protecting minors online. Accounts for users under 18 are placed in a pending state until a parent or legal guardian provides verifiable consent via a confirmation email.
- COPPA — under 13: For users under 13 years old specifically, we comply fully with COPPA. We collect only the minimum information necessary: name, email address, date of birth, and study data (chat sessions, quiz scores, flashcards, notes). We do not collect phone numbers, precise geolocation, photos, or any sensitive personal information from children under 13.
- No sale or sharing of children's data: We do not sell, rent, or share personal information from users under 18 with any third party for marketing or advertising purposes, ever.
- No behavioral advertising: Users under 18 are never shown targeted or behaviorally-based advertisements.
- Parental rights: A parent or legal guardian may at any time: (a) review the personal information we have collected about their child; (b) request corrections to inaccurate information; (c) revoke consent and request deletion of their child's account and all associated data; or (d) refuse to allow further collection or use of their child's information. To exercise any of these rights, contact us at support@schoolarise.ai.
- Parent dashboard: Parents who have linked their account may also manage their child's account, view activity, and request deletion directly through the Parent Dashboard.
- Data retention: If parental consent is not received before the request expires, the disabled pending account is quarantined as a cleanup candidate. The current cleanup job reports aggregate counts and does not delete those records; deletion requires a separately authorized retention process. Consent revocation disables access and permits a parent or guardian to request deletion through the applicable account-deletion workflow.
- Third-party services: We use a limited number of third-party services to deliver the Service, including Groq for AI inference and Vercel for hosting. PostHog and Vercel Analytics are optional for consenting adult users and are disabled for minors. The Privacy Policy describes the data sent to each provider and the applicable purposes.
If you believe we have inadvertently collected personal information from a child under 13 without proper consent, please contact us immediately at support@schoolarise.ai so we can investigate, restrict access where appropriate, and process an authorized deletion request.
10. Disclaimers & Warranties
- The Service is provided “as is” and “as available” without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.
- We do not guarantee that the AI tutor's responses will be accurate, complete, or appropriate for any particular academic purpose. The AI is a study aid, not a certified teacher.
- We do not guarantee uninterrupted or error-free operation of the Service. Downtime may occur for maintenance, updates, or unforeseen circumstances.
11. Limitation of Liability
To the fullest extent permitted by law, Schoolarise and its officers, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of profits, or academic consequences, arising from your use of or inability to use the Service.
Our total liability for any claim arising from the Service shall not exceed the amount you paid to us in the twelve (12) months preceding the claim, or $50, whichever is greater.
12. Account Termination
- You may request deletion of your account by contacting us at the email address below. We will explain the request's status and any minimized records that must be retained for billing, legal compliance, security, fraud prevention, or dispute resolution; these Terms do not promise deletion of every copy or category within a fixed period.
- We may suspend or terminate your account if you violate these Terms, engage in fraudulent or abusive behavior, or if required by law.
- For accounts belonging to users under 18, a parent or guardian may revoke consent or request deletion of the account at any time using the management link provided via email or through the Parent Dashboard.
13. Indemnification
You agree to indemnify and hold harmless Schoolarise and its officers, employees, and affiliates from any claims, damages, or expenses (including reasonable attorney's fees) arising from your use of the Service, your violation of these Terms, or your violation of any rights of a third party.
14. Changes to These Terms
We may update these Terms from time to time. Material changes will be communicated via email or an in-app announcement at least 30 days before they take effect. Your continued use of the Service after the effective date of the updated Terms constitutes acceptance.
15. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles. Any disputes arising from these Terms or the Service shall be resolved in the courts of competent jurisdiction.
16. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that the remaining provisions remain in full force and effect.
